1. Australian Consumer Law (ACL) Statutory Guarantees

1.2 Mandatory ACL Statutory Text:
- Consumer Guarantee Notice: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
1.3 Policy Prevalence: This Warranty & Faulty Goods Policy serves strictly as an operational guidance and triage framework for our customer service teams. It does not operate to limit, delay, reduce, or modify any non-excludable right, statutory remedy, or implicit warranty to which you are legally entitled under the ACL.
2. Objective Criteria for Determining Product Faults
2.1 Statutory Fault Metrics: In accordance with Australian consumer protection standards, a garment, shoe, or accessory distributed via our platform will be deemed faulty or non-compliant with statutory guarantees only where a thorough assessment verifies that it:
- 2.1.1 Fails to meet objective acceptable quality parameters, meaning it is not as durable, safe, or free from structural structural finish and appearance defects as a reasonable, informed consumer would expect given the product's price point and description.
- 2.1.2 Possesses an inherent, unadvertised safety hazard.
- 2.1.3 Is structurally or compositionally unfit for its explicitly disclosed or reasonably expected purpose.
- 2.1.4 Deviates significantly and materially from the product descriptions, specifications, or catalog mockups displayed on our Website.
- 2.1.5 Possesses a verified manufacturing defect in structural materials, stitchwork, zippers, or textile binding that existed prior to initial delivery.
3. Operational Defect Review Window & Internal Workflows
3.1 Purpose of the Internal Review Period: To ensure rapid customer service handling and efficient warehouse inventory logging, H&K Styles utilizes an expedited 30-day internal defect review period for potential manufacturing flaws, calculated from the official carrier delivery timestamp.
3.2 Statutory Preservation and Survival: This 30-day operational review window is a voluntary internal performance benchmark only. It does not limit, replace, or reduce your overarching legal rights under the Australian Consumer Law. Your right to a statutory remedy for a genuine manufacturing defect remains valid for the reasonable expected lifespan of the product, depending on the item's purchase price, fabric composition, and typical wear profile.
4. Express Exclusions from Fault Classification
4.1 Excluded Damage Thresholds: To the maximum extent permitted under Australian law, the following issues are explicitly excluded from classification as product faults or manufacturing defects, and do not trigger a right to a statutory remedy under this policy or the ACL:
- 4.1.1 Normal wear and tear consistent with the garment's textile composition, delicate nature, and expected operational lifespan.
- 4.1.2 Accidental damage, tearing, catching, fabric pulling, or zipper breaks caused directly by customer usage, try-ons, or storage.
- 4.1.3 Misuse, storage neglect, exposure to damp environments causing mold, or failure to maintain the garment in a clean environment.
- 4.1.4 Laundering damage caused by a failure to follow the care label instructions sewn into the item (including incorrect washing temperature, intense machine agitation, tumble drying, high-heat ironing, or inappropriate chemical dry cleaning).
- 4.1.5 Chemical fiber degradation, color stripping, or fabric bleaching caused by direct contact with perfumes, deodorants, cosmetics, sunscreens, tanning agents, or harsh external cleaning agents.
- 4.1.6 Structural damage or seam distortion directly resulting from independent alterations, cropping, fabric dying, or third-party tailoring interventions.
- 4.1.7 Theft, weather destruction, or physical damage occurring after delivery where you authorized an unattended "Authority to Leave" or "Safe Drop" delivery protocol.
- 4.1.8 Minor variations in fabric dye hues, textile weave, or exact dimension metrics within industry-standard apparel production tolerances (+/- 2cm).
5. Faulty Goods Claim Process & Tiered Remedies
5.1 Claim Ingestion Guidelines: To submit a formal faulty goods claim, you must contact our compliance team directly at info@handkstyles.com.au and transmit the following verification data:
- 5.1.1 Your full legal name, email address, and customer account identifier.
- 5.1.2 The original transaction reference code or Stripe order number.
- 5.1.3 A concise, objective description of the observed structural failure.
- 5.1.4 Clear, high-resolution photographs or video files capturing the specified defect in common uncompressed digital formats (e.g., JPEG, PNG, MP4).
5.2 Physical Warehouse Audit: H&K Styles reserves the right to require the physical return of the item to our Sydney facility for operational diagnostic assessment before approving a statutory remedy. Where a return is necessary for assessment, we will provide you with specific shipping documentation instructions.
5.3 Execution of Statutory Remedies & Stock Availability Limitations: If the diagnostic assessment confirms that the item breaches an ACL consumer guarantee, H&K Styles will provide a remedy based strictly on the statutory severity of the failure:
- 5.3.1 Major Failures: Where the defect constitutes a major failure, the customer maintains an absolute right to choose either a complete monetary refund back to the original payment source or an identical replacement product (subject to stock availability).
- 5.3.2 Minor Failures: Where the defect constitutes a minor failure capable of clean rectification, H&K Styles will provide a repair or an identical replacement within a reasonable timeframe at our cost.
- 5.3.3 Sold Out Stock Provision: If an item is verified as possessing a minor failure but is completely sold out or out of production across our warehouse network, making a replacement impossible, H&K Styles will default to providing either a full refund or store credit, determined at our sole commercial choice.
- 5.3.4 Alternative Options: A store credit or promotional digital voucher will only be issued if the customer explicitly requests it as a personal preference, or for minor failures where mutually agreed upon.
- 5.3.5 Postage Compensation: For all approved, legitimate ACL fault claims, H&K Styles will fully reimburse you for reasonable domestic return shipping costs upon the provision of a valid postage receipt.
