17.3 Statutory Escalation Rights Preserved: Nothing in this Section 17 operates to restrict, delay, or prevent a customer from lodging a formal complaint or seeking regulatory guidance from a relevant Australian administrative authority, including the Office of the Australian Information Communication Commissioner (OAIC), NSW Fair Trading, or the Australian Competition and Consumer Commission (ACCC).
18. Force Majeure & Technical Infrastructure Disruption
18.1 Exculpatory Circumstances: H&K Global Trading Pty Ltd and its individual directors are completely immune from any liability, transaction penalty, or breach claim for any delay or failure to fulfill their obligations under these Terms caused by events genuinely beyond our reasonable control. These events include, but are not limited to: natural disasters, acts of God, pandemics, international transport breakdowns, supply chain blockages, strikes, cyberwarfare, Distributed Denial of Service (DDoS) interventions, Hostinger data center outages, cloud hosting provider infrastructure collapses, upstream ISP routing disruptions, or core power grid failures.
18.2 Operational Mitigation & Refunds: Where a verified force majeure event prevents us from fulfilling an existing order under Section 5.2, we will notify you as soon as practicable. In the event that fulfillment becomes permanently impossible due to the disruption, we will cancel the unfulfilled transaction line and issue a full refund to your original payment method, which represents the maximum extent of our liability.
19. General Legal Frameworks
19.1 Clause Severability: If any provision, paragraph, or phrase within these global Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable under Australian law, that specific provision will be severed from the document. This severance will not affect the legal validity or enforceability of the remaining clauses, which will continue in full force and effect.
19.2 Non-Waiver Preservation: Any failure or delay by H&K Styles to strictly enforce or exercise any right, power, or remedy under these Terms does not constitute a waiver of that right, nor does it prevent us from enforcing it in the future.
19.3 Governing Law and Jurisdiction: These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and courts competent to hear appeals from those courts.
